Terms of Use

The use of the services available on this website (the "Service") is governed by these terms and conditions. Please read these terms and conditions carefully before registering for or using the Service. By registering you agree to the terms and conditions set out below.

1. About the Platform and Website

1.1 Eedeos Education Pty Ltd (the 'Platform') facilitatesacademic tutors(the ‘Tutor’) to upload their educational videos on the platform and students and their parents (the ‘Students’)to get access to these videos.(Tutors and Students are collectively termed as ‘you’, ‘your’)This functionality of the Platform is referred to in this document as the 'Services'.

1.2 The Platform is operated by Eedeos Education Pty Ltd (ACN 669 639 132) (‘we’, ‘us’, ‘our’). It is your responsibility to read these terms and conditions (the 'Terms') and Privacy Policy carefully before you register. If you do not agree with the Terms, you must cease usage of the Platform, or any of its Services, immediately.

1.3 From time to time, we may review and update these Terms to reflect new or different practices. Eedeos Education reserves the right in its sole discretion to make changes to these at any time. When we update the Terms, we will use reasonable endeavours to notify you by sending you an email or a notification on your mobile phone or other appropriate methods. Any changes to the Terms take immediate effect from the date of their publication.

2. The Services

2.1 You need to register and create an account in order to access the Services. (the 'Account').

2.2 As part of the registration process, or as part of your continued use of the Services, you will be required to provide personal information about yourself. You warrant that while completing the registration process any information you give us will always be correct, up to date and accurate. Once you have finished the registration, you will be a registered member of the Platform ('Member') and agree to be bound by the Terms.

2.3 o You must be at least 18 years of age to create an account on Eedeos Education and use the services. If you are a Student under 18 years of age, the Student must be a parent or guardian of the actual student who will receive the platform services.

3. Your obligations as a Member

As a Member, you agree to comply with the following:

  • You will not share your profile with any other person;
  • You have sole responsibility for protecting the confidentiality of your password and/or email address. Use of your password by any other person may result in the immediate cancellation of the Services;
  • Any use of your registration information by any other person, or third parties, is strictly prohibited. You agree to immediately notify us of any unauthorised use of your password or email address or any breach of security of which you have become aware;
  • Any content that you broadcast, publish, upload, transmit, post or distribute on the Platform ('Your Content') will always be accurate, correct and up to date and you will maintain reasonable records of Your Content.
  • You acknowledge and agree that any automated use of the Platform or its Services is prohibited.
  • You acknowledge and agree that nothing in these Terms create a relation of employer and employee, or principal and agent, or partner, or joint venturer between the Tutor Member and us. The Tutor Member must not hold themselves out as our agent or employee or as being a partner or joint venturer with us.
  • The Tutor is wholly responsible for accounting and remitting any taxes related to the income that the Tutor receives via the Platform. If we are assessed to be liable for any taxes in relation to any money paid to you, then you acknowledge and agree that we are entitled to deduct such liabilities prior to paying your subscription share.
  • Tutors are not our employees. We mere provide them services to put their educational videos on our platform.
  • We do not check content uploaded by tutors. So we are not liable for accuracy, usefulness and relevancy of content with current curriculum. Students need to use their own knowledge and judgment about this.
  • Permission is granted to watch video course on our platform only. You are not allowed:
    • to download, modify or copy the materials;
    • use the materials for any commercial purpose, or for any public display (commercial or non-commercial);
    • transfer the materials to another person or 'mirror' the materials on any other server
    • share login details to an individual who has not purchased a product, so that they may access course materials
  • Eedeos Education reserves the right to refuse or delete content that we believe is inappropriate or breaching the above terms. We also reserve the right at our discretion to restrict a person's usage of the Site either temporarily or permanently, or refuse a tutor or student registration.

4. Refund Policies

Online Video Courses are non-refundable. Refunds will not be provided unless there are exceptional circumstances and the decision to provide a refund is solely at the discretion of Eedeos Education. To request for a refund, a request in writing will need to be provided to Eedeos Education stating your name and contact details, the full history of the transaction in question, a detailed list of reasons why you are requesting a refund, copies of all relevant documents related to the situation and any other documents and information that may be deemed relevant. Requests for refunds will only be accepted if a request is made in writing (by email or letter). Credit may be given, at the Company’s discretion, to other Eedeos Education Video courses after cancellations.

5. Privacy

We take your privacy seriously and any information provided through your use of the Platform and/or Services are subject to our Privacy Policy, which is available on the Platform.

6. General Disclaimer

6.1 Nothing in the Terms limits or excludes any guarantees, warranties, representations or conditions implied or imposed by law, including the Australian Consumer Law (or any liability under them) which by law may not be limited or excluded.

6.2 Subject to this clause, and to the extent permitted by law:

  • all terms, guarantees, warranties, representations or conditions which are not expressly stated in the Terms are excluded; and
  • we will not be liable for any special, indirect or consequential loss or damage (unless such loss or damage is reasonably foreseeable resulting from our failure to meet an applicable Consumer Guarantee), loss of profit or opportunity, or damage to goodwill arising out of or in connection with the Services or these Terms (including as a result of not being able to use the Services or the late supply of the Services), whether at common law, under contract, tort (including negligence), in equity, pursuant to statute or otherwise.

6.3 Use of the Platform and the Services is at your own risk. Everything on the Platform and the Services is provided to you "as is" and "as available" without warranty or condition of any kind. None of our affiliates, directors, officers, employees, agents, contributors, and licensors make any express or implied representation or warranty about the Services or any products or services (including the products or services of the Tutors, and third-party service providers whose services are used by the Platform) referred to on the Platform. This includes (but is not restricted to) loss or damage you might suffer because of any of the following:

  • failure of performance, error, omission, interruption, deletion, defect, failure to correct defects, delay in operation or transmission, computer virus or other harmful component, loss of data, communication line failure, unlawful third party conduct, or theft, destruction, alteration or unauthorised access to records;
  • the accuracy, suitability or currency of any information on the Platform, the Services, or any of its Services related products;
  • costs incurred as a result of you using the Platform or the Services; and

7. Limitation of Liability

7.1 Our total liability arising out of or in connection with the Services or these Terms, however arising, including under contract, tort (including negligence), in equity, under statute or otherwise, will not exceed the resupply of the Services to you.

7.2 You expressly understand and agree that we, our affiliates, employees, agents, contributors, and licensors shall not be liable to you for any direct, indirect, incidental, special consequential or exemplary damages which may be incurred by you, however caused, and under any ground of liability. This shall include, but is not limited to, any loss of profit (whether incurred directly or indirectly), any loss of goodwill or business reputation and any other intangible loss.

7.3 You acknowledge and agree that we hold no liability for any direct, indirect, incidental, special consequential or exemplary damages which may be incurred by you as a result of providing Your Content to the Platform.
